Residents of Waterford will not get a chance to voice their opinions about the planned apartment building on Leamon Street since the developer has appealed this issue to the Ontario Land Tribunal.

During a council meeting in May, some councillors expressed concerns regarding a revised plan for the building-a four-storey, 39-unit apartment complex at 289 Leamon St.-and it was decided that it would be sent to a public hearing committee meeting in July where residents could share their thoughts.

However, by the time of the May council meeting, the 90-day deadline set by Ontario’s Planning Act for making a decision on the zoning bylaw amendment had already passed. This allowed the developer to bring their case to the OLT for a ruling.

At that meeting, Coun. Kim Huffman requested that “for good stewardship and community relations” the applicant refrain from going to the OLT before holding a public meeting.

The county issued an announcement on June 17 stating that due to this appeal, the application would no longer appear on the agenda for the public hearing committee meeting scheduled for July 7.

The applicant, B& B Landco Inc., initially sought a zoning bylaw amendment to allow for a five-storey, 44-unit apartment building with commercial space on the ground floor.

<p Nonetheless, after facing criticism from both Norfolk councillors and local residents regarding that proposal, they worked together with county staff on a more compact version of their plan.

Even after these adjustments, this new apartment building still exceeds current zoning bylaws by one storey and still seeks fewer parking spaces than what is required according to those laws.

The planning staff from the county recommended approval of this zoning change; however, some councillors remained concerned about parking issues and traffic impacts in that area.

Huffman mentioned she felt like this revised proposal “snuck in under the radar a little bit” and believed that local residents should have an opportunity to provide feedback.
