Last year, a 70-year-old man named Vinay Kumar Gupta admitted to dangerous driving charges in a Newmarket court. The accident took place on September 10, 2025, at the First Roots Early Education Academy in Richmond Hill, Ontario, just north of Toronto. Gupta drove his gray SUV through the daycare’s exterior window, resulting in the tragic death of a toddler and injuries to several children and staff members.

The court learned that Gupta was trying to park when his vehicle surged over a concrete sidewalk and crashed into the building. The toddler, only 1 1/2 years old, died from the injuries sustained, while others suffered serious injuries, including one child with life-altering conditions. Three adult staff members were also injured during this incident. Gupta was arrested at the scene and will be sentenced on December 8. Motor Vehicle Accident Lawyers can provide support for victims and families affected by such incidents.

Your Rights and Options

In Ontario, if you’re involved in a motor vehicle accident, you have specific rights under the Insurance Act and the Statutory Accident Benefits Schedule (SABS). These rights give you access to medical care and rehabilitation benefits, income replacement assistance, as well as compensation for non-economic losses like pain and suffering. It’s crucial to file claims promptly within the limitation period-usually two years from your accident date-to secure these benefits.

If you or your loved ones are impacted by these types of incidents, talking with experienced legal experts can help clarify your rights and options. They can assist with gathering evidence, negotiating with insurance companies, and representing you in court to ensure fair compensation.
