John Done, a barrister and solicitor with Kingston Community Legal Clinic, said his advice comes following two recent cases where tenants stood up to their landlords and as a result, were able to defeat eviction applications and remain in their homes.

According to the Advocacy Centre for Tenants Ontario, a form N12, or “Notice to End your Tenancy Because the Landlord, a Purchaser or a Family Member Requires the Rental Unit” is a form a landlord or their representative can give to their tenant as a notice of eviction in Ontario.

Done referred to the landlord’s applications as “no fault evictions” and said that in some cases, they are used to evict a tenant so they can raise the rent.

“Many tenants who receive a notice of termination from their landlord do what it tells them to do,” explained Done, whose clinic offers free legal aid to those who are eligible. “They just move out. They don’t understand that if they become actively engaged by attending a hearing, by retaining a lawyer or a licensed paralegal, there’s every chance that they can defeat these applications.”
