Alberta Minister Found in Violation of Election Rules

An investigation has revealed that Service Alberta Minister Dale Nally breached election law while responding officially to a recall petition aimed at him, but he will not face any consequences.

Nally accessed a private list of voters for “a purpose not authorized by the Election Act,” as stated by Elections Alberta commissioner Paula Hale in a letter dated Thursday.

However, she noted that there’s some uncertainty regarding whether using the list was appropriate given the situation and chose to close the case without reprimanding or penalizing Nally.

“Instead, Minister Nally was provided advice to support future use of the List of Electors,” she wrote.

The letter was sent to Deirdre Mac Lean, who made the complaint. She wasn’t available for comment on Friday.

In November, Nally, who represents the United Conservative Party, publicly asserted that the person leading the recall effort didn’t vote in the last election and questioned if that should invalidate the petition.

The Opposition NDP expressed concerns about how Nally used confidential information from Elections Alberta.

The petitioner, Joshua Eberhart, mentioned on Friday that he had no idea a complaint had been submitted.

He intended to file one himself but was waiting for financial statements to be approved by Elections Alberta before finalizing his recall process against Nally.

Last month, Elections Alberta announced that the recall effort against Nally did not succeed. About 2,600 signatures were collected-far short of the needed 15,700.

Eberhart said since his voter information was accessed, he would have liked to be involved in filing a complaint against Nally.

“I understand there are others besides me frustrated with this UCP government and its actions; in this instance, that includes making voter information public,” he said in an interview.

“So I appreciate other people wanting to ensure this government is held accountable. However, I felt surprised and wish I could have played a part in it.”

At that time, Premier Danielle Smith defended Nally in assembly remarks saying he misrepresented whether or not the constituent voted but dismissed calls for him to lose his responsibilities.

Eberhart also raised concerns about Smith using his personal voter details publicly and wondered if she had looked up his name on the electors’ list herself.

“It’s concerning,” he said. “MLAs seem willing to access these kinds of details and make offhand comments.”

Eberhart stated he wanted Nally punished for disclosing his voter information.

“As an ordinary citizen myself, I know I shouldn’t reveal other people’s private and confidential info publicly,” he remarked. “For him not realizing that’s wrong is quite absurd.”

Nally commented in a statement on Friday that he’ll follow Elections Alberta’s guidance regarding future use of voters’ lists.

“I have no further comment at this time,” he added.

A spokesperson for Elections Alberta stated they cannot comment on their investigative activities.

Rakhi Pancholi, deputy leader of the Opposition NDP criticized Nally for accessing information “he shouldn’t have about a constituent so he could try to publicly discredit him.”

This isn’t just about how sensitive this minister is; it’s also about how entitled UCP feels they can act without accountability toward opposition or even their constituents,” Pancholi remarked in a statement.

Eberhart claimed in his petition against Nally that he’s been ignoring constituents’ needs. He also criticized using Charter’s notwithstanding clause during a provincewide teachers strike as “an overreach by UCP government which Dale Nally is part of.”

Nally responded saying he’s being targeted by “a left-wing activist group weaponizing recall legislation against UCP MLAs aiming at provoking early elections.”

Every one of two dozen petitions filed against Smith and her UCP colleagues since late last year has either fallen flat or been withdrawn.

Two recall efforts targeting NDP members failed while one still active targets MLA Marie Renaud.

A separate effort aimed at Progressive Tory Party Leader Peter Guthrie continues as well.

The citizen-led petitions launched last year marked an initial use of Alberta’s Recall Act concerning provincial politicians brought under former UCP premier Jason Kenney designed with empowering citizens holding politicians accountable between general elections.
