Residents of Pelham Challenge Town’s Building Decisions

Residents of Pelham Challenge Town’s Building Decisions

Two single dwelling homes were torn down on Emmett Street in Fonthill and replaced by eight little homes. Neighbours are complaining that builders were not properly permitted by the Town of Pelham to erect the small complex.

Rob and Susan Grant have lived in their Fonthill home on Emmett Street for 21 years – the third generation in a house built by Susan’s grandfather back in the 1950s, located in one of Pelham’s original neighborhoods.

They were aware that change was on the horizon. The aging trees, ongoing issues with sewage, and road conditions were all part of living on an older street. They accepted this as part of life.

However, they didn’t anticipate what would unfold right across from them.

The single-family homes at 29 and 31 Emmett St. were demolished and replaced with eight smaller units – four on each lot – without any public meeting about the site, design review, or neighborhood consultation. No one from the Emmett Street development even knocked on neighbors’ doors to inform them about the changes coming their way.

“What they’ve done is just horrendous. It doesn’t match anything else on our street,” said Rob Grant. “It looks like it’s made with cheap materials and was quickly constructed just to get around regulations.”

For neighbors like the Grants and Mishelle Murselovic, there’s frustration not only over how it looks – a concrete structure Grant likened to a “prison camp.”

The bigger worry for them is whether the town adhered to its zoning laws by allowing four units per residential lot.

And how residents who voiced concerns felt they were treated by town officials.

In May, a group of residents known as Concerned Citizens of Pelham Corp. filed for a judicial review in Ontario’s Divisional Court, claiming that the Town of Pelham illegally issued building permits for Emmett Street and quietly modified zoning bylaws to facilitate this development.

The allegations from this corporation have yet to be proven in court.

“It asks the court to hold municipalities accountable for their actions and decisions when they go forward despite knowing it’s incorrect,” said lawyer Eric K. Gillespie, whose Toronto firm submitted the notice of application on May 8.

“Our firm is involved because we believe our client has valid legal issues worth bringing before the court.”

The application calls for a declaration that the town acted in bad faith and improperly when passing the amended bylaw. It also alleges that there was dishonesty and bias involved while misusing statutory powers.

The filing requests that any occupancy or further municipal approval related to the fourth detached unit at 29 and 31 Emmett St. be put on hold.

The zoning dispute

When Pelham passed its zoning bylaw in August 2022, it stated up to two additional residential units (ARUs) could exist inside one primary dwelling along with one ARU in a detached structure. The town explained that ARUs are additional to existing dwelling units, allowing four total units per residential lot.

“Between 2022 and 2026, it was lawful to build four units per property within urban areas of Pelham,” stated David Cribbs, chief administrative officer of the town, in a written response to The Standard.

“The Emmett Street project consists of one principal dwelling plus three ARUs per property.”

<pp Residents countered that allowing four residential units contradicts Pelham’s zoning law which allows only three total units per lot – one primary dwelling plus two additional ones.

They argue that the main building meets definitions set out for triplexes: buildings divided into three self-sufficient units each having its own entrance, kitchen, and bathroom. Triplexes aren’t allowed under R2 zones without going through rezoning applications or public consultations.

A memo sent to town council on Jan. 15,2025-roughly eight weeks prior>note: usage unclear but might refer time range timing=on actual events surrounding construction or rules changing based upon developer access dates noted earlier if seen elsewhere during document retrieval efforts undertaken herein%bb)%- revealed Pelham’s zoning law allowed only two ARUs within an existing dwelling plus one additional unit outside.

The memo indicates staff understood limits imposed meant three rather than four additional permitted structures; however officials assert documentation confirms issuing permissions aligned properly fitting established guidelines suggesting otherwise though conflicting interpretations sparked tension too regarding clarity expectations leading residents questioning validity behind current developments positioning moving forward despite previous acknowledgments seemingly finding faults found with original structures erected previously through exemptions granted may still uphold legality under scrutiny since necessary outlines lacking visible transparency hence generating doubts overall raised calling inquiry concerning legitimacy encountered throughout upcoming matters yet unresolved carrying ongoing scrutiny added directly looking ahead future landscape viewed reflections originating these recent incidents previously noted affecting community dynamics entirely restructuring heritage aspects potentially displacing cultural significance tied closely locality involved handling administrative affairs downplayed publicly prior noticing rising tensions surfacing internally brought forth arising new challenges undermining trust developed between parties engaged thus hindering constructive dialogue needed support fostering healthy progressivity embedded firmly respectful agreements established beforehand.
