Former Toronto Raptors head coach Nick Nurse is suing the Ontario government over a rejected tax refund of nearly $700,000 related to a home he and his wife once owned in Mississauga.
Nurse, who is now the head coach for the Philadelphia 76ers, has filed a notice of appeal with the Ontario Superior Court. The couple is contesting the Ontario Ministry of Finance’s decision not to rebate the $697,500 Non-Resident Speculation Tax (NRST) they paid when purchasing their $4.65-million property in 2021.
The legal dispute centers on whether they met the requirements for a tax rebate according to provincial rules at that time. In 2021, the NRST rate for qualifying foreign buyers in the Greater Golden Horseshoe area was set at 15 percent, which has since increased to 25 percent.
According to those earlier regulations, foreign buyers could claim a rebate if they met certain criteria. These included having continuous employment in Ontario for at least one full year and using the property as their main home for at least 60 days.
Property records indicate that the Nurses purchased their Mississauga home in October 2021 and sold it in September 2023. This sale took place shortly after Nurse’s ten years with the Toronto Raptors ended.
The Raptors parted ways with Nurse in April 2023, and he became head coach of the 76ers just a month later. The couple officially filed their NRST rebate application in March 2024, but it was denied by the Ministry of Finance.
Court documents reveal that the ministry turned down their claim because they were no longer living in their Mississauga residence when they submitted it. The Nurses’ appeal challenges this interpretation, claiming that regulations from 2021 did not legally require them to be residing there at submission time.
Additionally, their court filing points out that selling their Mississauga home was directly linked to Nurse’s move to Pennsylvania for his new role with the 76ers and not due to any property speculation plans. Although Ontario has updated its NRST rebate policy with stricter guidelines regarding permanent residency status since then, this legal challenge argues that these changes shouldn’t apply retroactively to their purchase from 2021.
No claims made in this legal appeal have been confirmed or adjudicated by a court yet.
For fans of Toronto sports, Nurse is still an important figure in local history. He began his first NBA head coaching job in 2018 and led the Raptors to an incredible achievement in 2019 by winning Toronto’s first NBA championship. This thrilling playoff journey ended with a six-game series win over the Golden State Warriors, bringing Canada its first Larry O’Brien Trophy.
Nurse followed this success by being named NBA Coach of the Year for the 2019-20 season thanks to a franchise-record.736 winning percentage during a regular season where they went 53-19. Over five years managing Toronto-after spending five years as an assistant-he built up a regular-season record of 227-163, making him one of only two coaches with such high winning percentages during his tenure with them when he left.
Outside his NBA commitments, Nurse also became head coach of Canada’s men’s national basketball team starting from 2019 right after leading the Raptors to victory.
Since leaving Toronto, Nurse has transitioned well into Philadelphia as he leads them through preparations for upcoming seasons following another postseason run into June next year as head coach going into their anticipated next season starting late fall.
