A “power of sale” occurs when a homeowner defaults on their mortgage, prompting the lender to sell the property to recover any unpaid debts. Unlike foreclosures that need court approval, these transactions are directly managed by the lender.
Power of sale transactions have resulted in significant losses for some homes across Mississauga, Brampton, and the Greater Toronto Area. For instance, one property in Brampton was bought for $1,380,000 in October 2021 but was re-sold in January for just $965,000 – a staggering loss of $415,000.
In Halton Hills, a home on an acre sold for $2,600,000 in April 2022 but went through a power of sale at only $1,865,000 just a month later-a loss totaling $735,000.

Tenants might find themselves facing eviction due to these sales. Douglas Kwan-a lawyer and director at the Advocacy Centre for Tenants Ontario-has noted an increase lately in tenant inquiries regarding power of sale situations.
This uptick is partially attributed to falling market rents coupled with many homeowners facing mortgage renewals at higher interest rates; thus rental property owners can easily fall behind financially.

Equifax data reveals that delinquent mortgages are rising this year across Ontario while Brampton holds the highest rate nationally-over twice as much as Canada’s average.
