Concerns Arise Over Hockey Dad’s Criminal History

A disagreement about whether a 13-year-old boy should join a minor hockey team in Whitby, Ont., has highlighted larger issues regarding how youth sports groups should deal with parents who have a history of sexually abusing children.

This spring, the player secured a place on a U-14 AA team within the Whitby Minor Hockey Association (WMHA).

However, when other parents discovered that the boy’s father, a former teacher from Durham Region, had been convicted of several sexual offenses against students, they raised concerns with the association about the father’s potential presence at practices, games, and other activities.

The WMHA then informed the family that their son could not participate on the team, as stated in emails obtained by . The family appealed this decision to the Ontario Minor Hockey Association (OMHA), which reversed Whitby’s decision and reinstated the player, referencing Ontario’s Human Rights Code in its Aug. 25 written decision obtained by .

Following this incident, the head coach of the team resigned.

has chosen not to identify the father because doing so would also reveal his son’s identity, who has not been accused of any wrongdoing.

This situation is further complicated by a 10-year court order that restricts the father’s contact with children under 16 while still allowing him to attend organized sports events involving his own child.

According to an order issued in January 2020 by Ontario Superior Court Justice M. S. Felix, he may attend sporting events where his child is participating. While he doesn’t need another adult accompanying him during those events, he must not be alone with anyone under 16 years old.

The order also forbids him from entering locker rooms where children under 16 are present or expected and from working or volunteering in positions of trust or authority involving kids under 16.

Difficult Situation for Officials

This order creates a challenging situation for hockey officials. The boy has done nothing wrong and faces no restrictions himself. But his father’s attendance around young players is controlled by a criminal court ruling aimed at limiting his access to children.

Mark Elsenaar, president of Whitby Minor Hockey, mentioned that the association found itself in a tough spot.

“It is unfortunate that a minor hockey player has become caught up in circumstances that are clearly not of his own doing,” Elsenaar stated.

He noted that they became aware of the father’s criminal record only after selecting teams had already taken place.

“Given the severity of that conviction, WMHA decided it was appropriate to remove the child from the team considering our obligations,” Elsenaar explained.

After disputing this decision made by his child’s father, Whitby sought advice from its governing bodies and initially believed it needed to reinstate the player as per guidance received from them. The association suggested some conditions and safeguards which were unacceptable to the family.

Whitby then continued excluding the player and informed them about their right to appeal. The player was reinstated last week after his father successfully appealed to OMHA.

“WMHA disagrees with this outcome but recognizes our limited resources make it difficult to contest it further; thus we must follow OMHA’s direction,” Elsenaar said. “We are still figuring out how best to implement this decision while ensuring everyone’s safety.”

Elsenaar expressed hope that they could collaborate with family members on establishing a plan that ensures safety for all involved parties.

One parent whose child plays on this Whitby team told they were informed families considered challenging OMHA’s decision legally but were advised by lawyers that “the case is unwinnable.”

“We aren’t prepared to discuss specific details regarding our discussions with families,” Elsenaar wrote in an email. “We approached this matter thoroughly , considering various factors. Ultimately , however , families weren’t willing agree upon what we thought was reasonable and necessary precautions.”

The OMHA did not respond when asked for comments.

Father Expects To Attend Practices , Games

In an email sent out via statement provided through - , the father shared he intends on attending around half teams practices , games & tournaments. He emphasized he’ll be there solely as parent supporting son & won’t partake in any meetings off ice functions or social gatherings associated with hockey.

He mentioned never having entered dressing room as parent & plans continuing avoiding such spaces altogether.

“Since my son’s reinstatement neither WMHA nor OMHA placed limitations on my attendance,” he said.

The father added courts took into consideration ability attend children’s sports activities when putting together prohibition orders permitting participation at these types events based upon parental rights connected directly involvement kids’ lives.
