Whitby Councillor’s Motion on Foreign Workers Declared Discriminatory

A law firm has ruled that a motion from Whitby Councillor Chris Leahy, which asked town staff to consider stopping contracts with companies involved in the federal Temporary Foreign Worker Program, is “discriminatory.” Lerners LLP states that such a change to the bylaw would “almost certainly be successfully challenged in the courts and struck down, exposing the Town to significant costs and reputational harm.” The law firm believes the motion goes against the Ontario Human Rights Code, which prohibits discrimination based on citizenship, as well as Charter protections for temporary foreign workers. Leahy tried to present this motion during a council meeting in February, but it was deemed out of order by Mayor Elizabeth Roy. He claims his goal was to tackle rising unemployment.
