A resolution has been achieved through a mediation process led by the Ontario Land Tribunal (OLT) regarding a proposed subdivision by CAIVAN (Perth GC) Limited, moving a significant planning disagreement closer to a conclusion.
This settlement follows multiple mediation sessions that took place throughout the year under Case Number OLT-23000534. These sessions included representatives from the Town of Perth, Lanark County, CAIVAN, legal teams, expert witnesses, and a mediator appointed by the Tribunal.
The town reports that mediation meetings occurred on Feb. 14, March 16, April 30, May 30, Aug. 19, Sept. 23 and Oct. 23. This process allowed all involved parties to share information, clarify planning and technical concerns, and navigate areas of both agreement and disagreement with guidance from the OLT mediator.
Now that mediation is finished, the case moves into the official settlement approval phase of the Tribunal’s process. Legal representatives are currently drafting the Minutes of Settlement which will then be reviewed and signed by the Town of Perth, Lanark County, and CAIVAN.
After gaining approval, the Minutes of Settlement will be made publically available and a public meeting will be organized to discuss settlement details and give interested parties an opportunity to learn more. The Town indicates this meeting could take place as soon as January 2026; however, specific dates and locations are yet to be confirmed.
Participants in the OLT proceedings will also have a chance to update or retract their earlier submissions according to timelines set by the Tribunal. A hearing at OLT will follow to examine the Minutes of Settlement along with participant statements before a final decision is reached by the Tribunal. The date for this hearing has not been established yet.
The Town of Perth acknowledged that residents and stakeholders have been actively monitoring developments regarding this proposed subdivision alongside ongoing OLT processes. Although detailed information has been limited due to ongoing tribunal activities thus far, the Town expressed its commitment to transparency.
Once finalized and approved, full details about the Minutes of Settlement will be accessible on the Town’s engagement website and presented during the public meeting.
This settlement represents an important move toward regulatory clarity for Ontario’s construction and development industry concerning CAIVAN’s proposed project while awaiting final approval from the Ontario Land Tribunal.
