An Oshawa resident has a message for homeowners after Durham Region decided not to pay $1,600 in plumbing fees linked to a tree owned by the city.
Bev Fiddler feels that the region is enforcing its bylaw unfairly, penalizing her and her husband for taking quick action earlier this year to fix a problem they didn’t create.
“There is no room for flexibility or no room to at least hear the homeowner’s position,” she stated.
Fiddler was doing laundry in her basement around 8:30 p. m. on January 3 when she realized the sink wasn’t draining properly. Her husband tried using a plunger, but they soon discovered that the water coming back contained raw sewage.
They then noticed water “spilling out” from the sealed water main drain located in their basement’s electrical room, according to her account.
“It was coming out quickly and it was like it’s going to start flooding,” she explained.
The couple used towels to soak up the water and called an emergency plumber. The plumber took off the water main seal and found a “massive tree root” obstructing the water main, which caused all of the damage, she noted.
According to Fiddler, the plumber told them that the tree responsible was about nine meters from their home and that it fell under the responsibility of City of Oshawa.

The city’s bylaw states that while they will clean sewer services including unblocking them, if someone cleans without prior authorization from them “there will be no reimbursement.”

‘This was not our fault’
