A man from Mississauga faces impaired driving charges after he was found by police in Guelph, having fallen and injured himself while riding his e-bike on Tuesday night.

The Guelph Police reported that the man also had his driver’s licence suspended for 90 days since electric bikes “are considered motor vehicles under the Criminal Code of Canada and operators are subject to the same impaired driving laws as the operators of any other motor vehicle.”

According to police, an officer discovered a man lying on the sidewalk near Gordon Street and Nottingham Street shortly after 9 p. m. He was being assisted by someone passing by.

“Investigation revealed the man was riding his e-bike when he lost control and fell over, with the bike falling on top of him,” police stated in a news release on Wednesday, noting that the rider was taken to hospital for treatment.

While talking to the man, the police officer noticed a smell of alcohol and “noted signs of impairment,” they added.

The man was arrested after failing a roadside breath test, with further breath samples indicating he had exceeded the legal limit of alcohol in his system, according to police.

A 40-year-old man from Mississauga is now charged with impaired driving. His licence has been suspended for 90 days.

As e-bike usage continues to rise across Ontario, police remind riders that they must adhere to Highway Traffic Act rules and regulations. They need to follow the same road rules as cyclists.

Additionally, those who ride e-bikes must be at least 16 years old and wear an approved bicycle or motorcycle helmet.

Riders should also keep in mind that different municipalities may have their own bylaws or restrictions regarding where e-bikes can be used, as mentioned by Ontario Provincial Police earlier.
