In a key legal decision, Justice Michael R. Gibson has stated that the Region of Waterloo cannot clear out a homeless encampment in a parking lot in Kitchener, Ontario. The ruling is based on the fact that the local bylaw aimed at removing the encampment violates the residents’ Charter of Rights and Freedoms. This encampment has provided shelter for many since 2021 when numerous individuals experiencing homelessness sought refuge outdoors during the COVID-19 pandemic.

This ruling is significant as it emphasizes the rights of homeless people over regional development plans, which has led to criticism from Premier Doug Ford, who referred to the decision as “cockamamie.”
