Discrepancies Emerge in Kingston Landlord’s Trial Post-Fire Tragedy

A provincial offences court in Kingston, Ont., heard conflicting testimonies on Thursday regarding a landlord whose property was engulfed in flames in 2023, resulting in the deaths of two individuals.

The city claimed that Prithvipal (Paul) Dadiala did not comply with Ontario’s fire code and failed to provide his vulnerable tenants with the safety standards they deserved.

The defence portrayed Dadiala as a person who offered support to those in need by providing housing for people facing hardship.

This hearing took place more than three years after a fire broke out at 895 Montreal St. on March 30, 2023.

Initially, Dadiala faced nine charges under Ontario’s Fire Protection and Prevention Act. However, six were dropped last August when he pleaded guilty to three remaining counts:

Not having doors that met proper fire protection ratings. Not installing a carbon monoxide detector. Failing to supply a fire extinguisher.

Court documents indicated that eight individuals were present inside the building when the fire ignited.

Among them, Bonnie Demille, 35, and her boyfriend Adam Crowley, 34, were situated on the second floor when flames erupted from a kitchen cabinet and rapidly spread throughout the property. Both Demille and Crowley lost their lives due to the incident.

Family Members Struggle with Emotions in Court

Three relatives of Demille shared victim impact statements on Thursday, expressing how her passing has left them heartbroken.

Alma Clark, Demille’s mother, wept as she recounted her last conversation with her daughter just hours before the tragedy struck.

Even after all this time, Clark mentioned she still finds herself dialing her daughter’s number only to remember it will never be answered again.

Another daughter, Melissa Demille, reflected on grieving for her sister over the past 1,161 days while lamenting that if the house had adhered to current fire codes, “she may have had a fighting chance and may even still be with us today.”

She remembered her sister as always cheerful and vibrant-someone whose personality could light up any room.

As one of the first people at the hospital that night, Melissa said she continues to be haunted by the smell of smoke; backyard bonfires have become distressing reminders as she contemplates what it must have been like inside their burning home.

Melinda Jackson echoed similar sentiments about being tormented by memories.

“I am the big sister. It’s my job and responsibility to take care of younger siblings; I feel I let Bonnie down,” she stated.

The city’s lawyer Andrew Reeson remarked that while there was no claim suggesting Dadiala intended harm towards anyone, he was accountable for maintaining his property according to fire regulations.

The landlord “acknowledged he was negligent” concerning these responsibilities while describing his tenants as “vulnerable people” who deserved basic safety standards set forth by fire codes.>

“They tolerated living conditions.. because they had nowhere else to go,” noted Reeson. “No matter what circumstances existed at that property; those tenants called it home.”>

The City Seeks Jail Time Alongside Financial Penalties

The lawyer requested a sentence including up to 30 days imprisonment along with a $15,000 fine and up to one year of probationary supervision.>

Mentioning the “severe tragic consequences” stemming from this fire incident,Reeson asserted that an appropriate sentence is necessary not only for accountability but also as an alert for other landlords across Ontario regarding their obligations.

A thorough CBC investigation revealed that following this blaze,numerous city inspections discovered various building code violations across multiple properties owned by both Dadiala himself along with family members-totaling twenty-seven properties within Kingston.

Dadiala’s attorney Matt Hodgson responded during proceedings stating all deficiencies highlighted previously have now been rectified-including concerns raised by local officials regarding these buildings’ conditions.

Dadiala reportedly invested nearly $300,000 into improvements across other properties thus far according his lawyer,who emphasized how deeply sorry his client feels towards victims’ families.

“The lesson has been learned. The tragedy won’t be repeated,” he remarked during arguments. >

The Defence Highlights Landlord’s Supportive Role

Hodgson further explained how Dadiala,aged seventy-eight,provides both financial assistance alongside emotional backing towards his wife及children making him unsuitable for incarceration.>

Это должны делать те кто действительно хотят изменить ситуацию…. Или по крайней мере попытаться правильно выполнить эту задачу……для того чтобы сделать шаг вперёд требуется время…… Слишком много людей оказались жертвами такой ситуации поэтому важно предотвратить подобные инциденты в будущем поскольку…. Практика показывает что наличие компромисса приводит к успешному разрешению конфликтов….как показывает опыт многих стран мира…
