In the years leading up to the death of a 12-year-old boy in the home of his potential adoptive parents, the Children’s Aid Society (CAS) had received at least six reports from concerned individuals regarding possible abuse and neglect, an Ontario court has heard.
However, the boy and his younger brother stayed in the care of Brandy Cooney and Becky Hamber for over five years, from October 2017 until December 2022, when the boy was found severely underweight, soaked, and unresponsive in their Burlington residence.
He passed away shortly after arriving at the hospital.
The women are now facing trial on charges of first-degree murder concerning the boy, referred to as L. L. in court, along with confinement, assault with a weapon, and failing to provide necessities for his brother, J. L. The boys’ identities are protected under a publication ban.
Both women have pleaded not guilty.
The judge-only trial began last month in Milton and is expected to continue into December.
No one from CAS has testified yet regarding what actions they took to assist the boys; however, this case has sparked questions about their involvement leading up to L. L.’s death.

Boys’ grandmother opposed their relocation, court hears
L. L. and J. L. were born about two years apart in Ottawa and initially lived there with their birth parents and grandparents before being placed with Heather Walsh and her family by children’s aid, as Walsh testified as their long-term foster mother. When CAS started the adoption process with Cooney and Hamber, the boys’ grandmother contested it in court but ultimately lost her case according to Walsh. L. Hamber and Cooney never completed the adoption process. Erin Nolan, a therapist at a children’s mental health center in Oakville testified that CAS had concerns regarding how well these women responded to “allegations” made by the children and mentioned that they didn’t collaborate effectively with service providers. Nolan was part of a team hoping to provide therapy for L. L. and J. L., which communicated with Cooney and Hamber throughout 2021 into early 2022. “Ottawa CAS was still assessing [Cooney’s and Hamber’s] capacity to meet the boys’ needs,” Nolan said. The women also tended to “pathologize” their children viewing them as psychologically unhealthy when they might not have been according to Nolan’s testimony. The two ultimately opted out of utilizing Nolan’s services because they disagreed that she was required to report any concerning claims made by the boys to children’s aid. The women claimed L. L. lied stating that CAS would be “banging down their doors at night which would disrupt their family,” Nolan testified.Therapist along with police notified CAS
The Crown argued that Cooney and Hamber struggled significantly caring for these boys while also allegedly hating them leading to neglectful or abusive behavior toward them. Yet they relied heavily on financial support through government adoption programs according to Crown attorney Kelli Frew’s opening statement. Diving deeper during cross-examinations defense lawyers focused on behaviors exhibited by L. J., claiming he was exceptionally difficult to manage while stating that both women were doing everything possible without adequate help or support from children’s aid.”Attachment therapist Beth Sibley worked alongside these boys during their transition period noting immediate concerns over parenting abilities displayed by both women.
During one session early on while residing Burlington , L. L., then six years old told Sibley he’d “punched”Hamber due feeling angry about being denied screen time ; therefore forced remain confined within room all day skipping school altogether. She remarked this punishment seemed excessively harsh reporting situation children ‘ s aid. “We know if child isolated it causes them stress distress creates more behaviors,”Sibley explained testifying before jury. Halton police reported incident occurring within Cooney’s home too according another filed exhibit document presented during court proceedings. In summer 2019 neighbor called authorities after hearing one those kids crying screaming loudly lasting “for well over five minutes”, the report indicated. Upon officer arrival, Hamber & Cooney claimed L. J. were throwing tantrum backyard calming down afterwards; however officer noted “no immediate risk” present time, and found youngsters “sufficiently cared for” basic necessities but evidently having trouble adjusting new environment.
