A law firm has concluded that a motion from Whitby Councillor Chris Leahy, which directs town staff to explore banning contracts with companies involved in the federal Temporary Foreign Worker Program, is “discriminatory.” Lerners LLP states that such a bylaw change would “almost certainly be successfully challenged in the courts and struck down, exposing the Town to significant costs and reputational harm.” The law firm believes the motion violates the Ontario Human Rights Code, which prohibits discrimination based on citizenship, along with Charter protections for temporary foreign workers. Leahy attempted to present this motion at a council meeting in February, but it was deemed out of order by Mayor Elizabeth Roy. He claims he was trying to tackle rising unemployment.
