Emergency Responses Face Penalties from Red-Light Cameras

Emergency Responses Face Penalties from Red-Light Cameras

For years, red-light cameras in Ontario have been catching everyday drivers, but now some police officers rushing to emergencies claim they’re being unfairly penalized by the same system.

The union that represents almost 500 officers in Windsor stated that each time one of its members receives a ticket from a red-light camera, the service deducts six hours of pay for the first offence. If it occurs again, the officer loses 12 hours of pay.

“You’re working a day and a half for free,” said Kent Rice, president of the Windsor Police Association.

Rice explained that officers are well-trained and already have discretion to perform their duties, which shouldn’t stop when they enter an intersection at a red light. 

“I get the need to balance public safety, but I also think this wasn’t what the [legislation] was meant for. They’re given discretion for a reason,” said Rice. “I doubt the public would agree this is what the legislation intended.”

For example, Rice noted that if an officer is responding to an urgent call such as an active domestic incident, break-in, or someone being shot – and wants to make a right-hand turn on red late at night – coming to a complete stop might not be necessary.

“You can see from blocks away that no one is coming,” said Rice. He added that factors like the type of call, time of day, and type of intersection influence how an officer reacts.

“I want them focused on doing their job and getting to [the emergency], not worrying about facing [discipline] or penalties for going through a red light.”

Rice recalled that when he was on patrol as an officer, 911 dispatchers would show concern about reaching someone needing immediate police help.

“You can hear it in their voice. They’re like, ‘We need officers to step it up,’” said Rice. “Officers will indeed make that discretionary decision that they need to get there fast.”

spoke with one current officer whose pay was docked after being caught by a red-light camera while attending to a Priority 1 – which is considered the most urgent type of law enforcement call. The officer’s identity remains confidential due to fear of repercussions for speaking out.

The officer made it on-site just in time to make an arrest.

“Instead of getting praise like ‘Great job catching him,’ it’s more like ‘Here’s your six-hour penalty,’” remarked the officer.

‘You feel so betrayed by your organization’

In those moments, he shared they didn’t even consider being penalized.

“We all drive safely. You roll almost completely stopped; you look both ways and if it’s clear you go because your mindset is ‘I gotta catch this guy.’ That’s why we signed up.”

The officer mentioned now they’re starting to think about red-light cameras when they should only be concentrating on handling emergencies.

“Anger is what I’m feeling. It feels like betrayal from my organization,” said the officer.

“It’s very frustrating since it feels like punishment without justification.”

The officer hopes Windsor police administration will use rational thinking when looking at each specific situation regarding any infractions related to running a red light and grant exemptions if appropriate.

The Windsor Police Service (WPS) has yet not responded multiple times from regarding its policy concerning red-light cameras.

An internal discipline directive obtained by through freedom-of-information request does not clarify whether each situation’s specifics are reviewed prior to docking hours off officers’ pay.

Rice stated he’s unaware of any case where an officer caught by such cameras hasn’t faced penalties.

Officers stop yet still disciplined, union says

Rice mentioned he’s learned some officers do come fully stopped at white lines but still face discipline because police vehicles can accelerate quickly in large intersections triggering these violations.

Beneath Ontario’s Highway Traffic Act rules permit police personnel crossing through red lights while having sirens blaring after stopping safely first.

A few instances across Canada revealed first responders were found accountable resulting accidents caused during crossings over reds.
