Developer Faces Charges Over Unauthorized Home Sales

An Ontario regulator that oversees home builders has charged seven companies operating under one developer for the unauthorized sale of 453 homes.

The Home Construction Regulatory Authority (HCRA) stated that the charges against State View Homes, a Vaughan-based home builder, came after an investigation revealed numerous alleged violations of provincial laws, specifically the New Home Construction Licensing Act, 2017, and the Ontario New Home Warranties Plan Act.

Three senior executives from the company-Dino Taurasi, Carlo Taurasi, and Daniel Ciccone-have also been charged for allegedly not taking adequate steps to prevent these violations, according to a news release from HCRA on Tuesday.

The HCRA noted that builders must be licensed by them in order to legally sell new homes in Ontario. Additionally, builders must get approval from Tarion, which is Ontario’s home warranty agency, and enroll each home in a warranty program.

The allegations against State View Homes include selling multiple homes without a license and failing to secure necessary Tarion approvals or enrollments in Ontario’s new home warranty program for hundreds of homes even after obtaining their license.

“Compliance with all regulatory requirements is not optional,” Wendy Moir, the HCRA’s CEO and registrar, said in the release. “Builders who do not meet these obligations are operating illegally, and the HCRA will take strong enforcement action.”

The HCRA mentioned it suspended State View’s licenses back in July 2023 to safeguard consumers from any further risk. Following its investigation, it said the “scale of violations and the financial harm involved” led them to file charges against both the company and its executives.

“Ontario home buyers deserve confidence that their builder is acting in good faith and complying with the law,” Moir said.
