New Regulations for E-Scooters and E-Bikes in Whitby

The Town of Whitby – with pilot programs running on either side in Oshawa to the east and Pickering and Ajax to the west – has introduced a new by-law for e-scooter and e-bike usage.

As micromobility devices have gained popularity, there was a need to establish a bylaw that prioritizes the safety of both e-bike and e-scooter riders, along with other users of town roads, paths, and trails, according to a statement included in the mayor’s newsletter.

The Rules

Under Whitby’s new bylaw, the minimum age to operate an e-bike or e-scooter is 16. Helmets are required for all e-bike riders and for all e-scooter riders who are under 18 years old. E-bikes and e-scooters can be used on Whitby’s roads, paths, and trails – but they’re not allowed on sidewalks. Keep in mind that e-scooters are only permitted on roads where the posted speed limit is 50 km/h or less. The maximum speed allowed is 20 km/h on multi-use paths and trails. On roads, the top speed is 24 km/h for e-scooters and 32 km/h for e-bikes. Certain micromobility devices aren’t allowed on Whitby’s transportation network, including electric hoverboards, electric skateboards, Segways, and electric unicycles.

The town emphasized that limited-speed motorcycles and motor-assisted bicycles-commonly known as mopeds-are classified as motor vehicles under the Highway Traffic Act and are prohibited from using Whitby’s multi-use paths and paved trails.
