Toronto | Traditional territories of the Mississaugas of the Credit, the Anishinaabeg, the Haudenosaunee, and the Wendat – Ecojustice has submitted a formal petition on behalf of Environmental Defence and Ontario Nature. This petition asks Honourable Julie Dabrusin – the federal Minister of Environment, Climate Change and Nature – to recommend that the federal cabinet issue an Emergency Order to safeguard Piping Plover habitat at Wasaga Beach. This area is crucial as it’s Ontario’s most important nesting site for this endangered migratory shorebird.
The petition emphasizes immediate action under the federal Species at Risk Act to protect vital habitat at Wasaga Beach from harmful mechanical beach raking scheduled by the Town of Wasaga Beach for this spring. Known as the world’s longest freshwater beach, Wasaga Beach has been responsible for 70 percent of all Ontario fledged Piping Plovers that made it to adulthood since their return in 2007. Without prompt federal action, these birds face serious threats to their survival and recovery in Ontario.
Recent changes by the Ontario government have weakened key protections for this vital Piping Plover habitat. On June 5, 2025, amendments were made to Ontario’s Endangered Species Act that redefined “habitat” in a way that excludes beaches from protection once migratory birds like Piping Plovers leave for winter until they return in spring. This severely limits protections even while birds are present. Piping Plovers are known for their strong attachment to specific sites and depend on essential habitat features like dunes, natural debris, and native plants for survival. Removing these natural elements through mechanical raking before they return could destroy their habitat and likely cause them to abandon nesting areas or disrupt courtship activities while making them more vulnerable to predators. Furthermore, on November 27, 2025, amendments were made to the Provincial Parks and Conservation Reserves Act that stripped portions of Wasaga Beach Provincial Park of protections including critical habitats identified for Piping Plovers.
These rollbacks in legal protections have created immediate dangers that could be catastrophic for the overall population of Plovers. The Town of Wasaga Beach has already acquired mechanical raking equipment and has cleared Allenwood Beach, another area that lost its protections in 2025. Additionally, they announced “Destination Wasaga,” a commercial development plan where mechanical beach clearing and construction are set to take place near known nesting sites.
Previous studies and legal rulings have shown that mechanical beach raking destroys essential natural debris needed by Piping Plovers throughout various life stages such as nesting, feeding, and hiding from predators. Evidence from other Ontario nesting locations indicates that after mechanical raking was done there, returning migratory Piping Plovers did not come back in subsequent years. With only three other active breeding sites remaining in Ontario by 2025, losing Wasaga Beach would be disastrous for this species. It’s crucial that Wasaga Beach remains both a thriving habitat for endangered piping plovers as well as a prime tourism destination.
The petition seeks an Emergency Order from the federal cabinet protecting all critical habitat at Wasaga Beach from mechanical raking activities and development plans at minimum. This order must be issued by March 1, 2026; otherwise groups may pursue legal action against noncompliance by the Minister.
Tim Gray, Executive Director at Environmental Defence said: “Only the immediate action of the federal government stands between the loss or survival of the endangered piping plovers of Wasaga Beach. It is very rare to see such a clear, immediate and extreme threat to the survival and recovery of an endangered species in Canada. The time for action is now.”
Kegan Pepper-Smith, lawyer with Ecojustice said: “The emergency order tool under SARA was specifically designed for these types of urgent situations where a species is facing imminent threats to its survival or recovery.”
“The Minister must uphold her responsibility to recommend Cabinet issue an emergency order to stop Town officials from destroying Ontario’s most important nesting sites for the Piping Plover. And she needs act quickly; neither unreasonable delay nor inaction is permissible under SARA.”
Tony Morris, Conservation Policy and Campaigns Director at Ontario Nature said: “Wasaga Beach is Ontario’s most critical nesting site for this endangered piping plover species; it cannot handle any further disturbance,” he stated firmly. “The Government of Ontario has indicated migratory birds fall under federal jurisdiction; therefore it’s essential that our Minister takes swift actions now.”
