In a notice of appeal dated July 6, Nurse and his wife allege the provincial government wrongfully denied them a rebate on foreign buyer tax they paid on their Mississauga home.

Former Toronto Raptors head coach Nick Nurse and his wife are currently involved in a legal dispute with the Ontario government regarding their claim for nearly $700,000 in foreign buyer tax that they paid on their home in Mississauga. 

A notice of appeal dated July 6 and submitted to the Ontario Superior Court of Justice claims that the provincial government incorrectly denied Nurse and his wife a rebate for a non-resident speculation tax (NRST) they paid when purchasing their home in 2021 for $4.65 million. 

This provincial tax is levied on residential properties bought by “individuals who are foreign nationals,” as stated on the province’s website.

The notice asserts that Nurse and his wife Roberta “were not the type of real estate speculators the Legislature aimed to address.” 

According to their appeal, the home served as the principal residence for Nurse and his wife from 2021 until 2023.

Nurse contributed ‘significant’ value to province: appeal

The notice indicates that during their time living at the property, both Nurse and his wife were considered foreign nationals in Canada. However, it also mentions that Nurse held a foreign national work permit and had been employed by Maple Leaf Sports and Entertainment LTD., which owns the Raptors, for nearly a decade. 

“Mr. Nurse brought significant economic and social value to the province,” states the notice of appeal.

Nurse led the Raptors to their first-ever championship victory in 2019. After being let go in 2023 due to a disappointing season where they missed out on playoffs, he went on to coach the Philadelphia 76ers. 

The notice claims that according to provincial rules, Nurse and his wife qualified for an NRST rebate on their home purchase. 

An email sent Tuesday from Mike Collinge, who represents them legally, stated that there would be “no further comment at this time.”

The provincial government’s website mentions that a foreign national may qualify for an NRST rebate if certain conditions are fulfilled, which include: 

Initially paying the NRST. Becoming a permanent resident of Canada within four years from when they purchased/acquired property. Occupying said property as their principal residence.

The government previously offered transitional NRST rebates allowing foreign workers in Ontario eligibility if specific criteria were met, provided their purchase agreement was made on or before March 29, 2022. The deadline for applying was March 31, 2025..
  • The notice notes that Nurse and Roberta applied for this rebate but were denied because they didn’t occupy their home up until they filed for it.
  • The appeal argues that this was not a requirement when they submitted their application.. Nurse and his wife applied for it back in March 2024 after selling their Mississauga home in September 2023.. They received word of denial in April 2024 after filing an objection challenging this decision. A series of communications followed with ministry officials until confirmation came on April 10 this year denying them again.Nurse. They’re now appealing. They’re seeking $697,# ,500 plus interest along with “further relief” deemed appropriate by court.#
