Four Lives Lost in Highway 401 Tragedy

Two grandparents and their infant grandchild were among four people who died in a tragic crash east of Toronto on Monday after police chased a suspect involved in a liquor store robbery, according to Ontario’s police watchdog.

Monica Hudon, a spokesperson for the Special Investigations Unit (SIU), stated that the robbery suspect also perished in the collision, which involved at least six vehicles.

All four victims were declared dead at the scene on Highway 401 in Whitby, located about 50 kilometers east of Toronto, Hudon said. Another person was taken to the hospital with serious injuries, she noted.

Hudon mentioned in an email later on Tuesday that the injured individual was thought to be in the cargo van being pursued by police.

The chase began at an LCBO location in Bowmanville, Ont., within Clarington’s regional municipality, when an off-duty officer reported an attempted theft to Durham Regional Police around 7:50 p. m. ET.

The suspect entered a cargo van and responding officers followed as they drove “erratically” through various streets, according to Hudon. She added that investigators are still working on identifying the suspect and did not provide any further details such as age or gender.

The suspect then entered Highway 401 at Stevenson Road, heading westbound against traffic in the eastbound lanes, Hudon explained.

A video shared on X, formerly Twitter, shows what seems to be a rental van speeding through oncoming traffic with Durham police vehicles closely behind. The video then shifts to show the aftermath of a fiery crash beside the highway. (CBC Toronto has removed that video but you can see some of it in the report linked at the top of this story.)

The crash occurred around 8:10 p. m., according to Hudon. She could not confirm if anyone else was inside the cargo van with the deceased robbery suspect.

A 60-year-old man, a 55-year-old woman, and their infant grandchild were traveling together in one vehicle during the crash, as per Hudon’s information. She did not have additional details about them late Tuesday morning.

SIU Will Review Pursuit Circumstances

In another video captured from a different angle and shared online, a severely damaged transport truck can be seen crashed against the concrete barrier at the accident site.

Hudon indicated that five investigators from SIU have been assigned to this case along with one forensic specialist and one collision reconstructionist. They are still trying to determine how many Durham police officers will be classified as subject or witness officers during this investigation.

Whether it was necessary for Durham police to pursue this cargo van driving against traffic on such a busy highway will be part of their investigation process,” said Hudon.

The SIU is an independent agency responsible for examining incidents involving police officers that may have led to death or serious injury or firearm discharge events.

Pursuing High-Speed Chases: When Is It Justified?

According to the Ontario Community Safety and Policing Act a police officer should only start pursuing someone if they’ve first assessed whether public safety risks caused by chasing outweigh those posed by letting them go without immediate apprehension or identification.

Steven Summerville, who used to work as a Toronto police officer and now teaches at Ontario Police College stated that SIU will review all factors surrounding this chase incident closely.

“I can’t speak to what evidence officers had or concerns [they] faced,” Summerville told CBC Toronto Tuesday afternoon.

“Before anyone rushes into judgment I think it’s essential we gather all facts. We must keep open minds about whether risks taken were reasonable back then.”

Summerville mentioned investigators would also consider how serious of an offense related specifically regarding robberies committed by suspects like these ones encountered here during today’s events.
