The individual involved in a troubling incident at a shopping mall parking lot in St. Thomas is expressing regret through his attorney.

Mark Phillips, a lawyer from Toronto, appeared in court on Monday in St. Thomas and was granted $5,000 bail.

The 37-year-old faces three counts of assault with a weapon and one count of aggravated assault.

“My client, Mr. Phillips, wants to apologize to Sergio Estepa and his family,” said attorney Steven Skurka while speaking to reporters outside the Elgin County Courthouse. “These are good people, fine members of the community. Mr. Phillips wishes Mr. Estepa a speedy and healthy recovery.”

The altercation, partly captured on a cellphone video, shows a man exiting a white BMW wielding a baseball bat while shouting “terrorist” and “ISIS,” as someone off-camera can be heard telling him to “stay away.”

St. Thomas police were alerted to the scene around 4:30 p. m. on December 7 and managed to locate a suspect later that evening in south London with assistance from London police.

Estepa was at the mall with his wife, Mariuxis Zambrano, their 13-year-old son, and a friend when he was attacked. The 52-year-old was hospitalized for severe bruises and a cracked rib.

Phillips has been released under several conditions including surrendering his passport to St. Thomas police, not entering Elgin County except for court appearances, and being prohibited from possessing weapons. His parents will serve as sureties for him.

“My client Mark Phillips is grateful to be free, is looking forward to his day in court, and the resolution of these charges,” added Skurka.

Phillips is scheduled to return to court on January 23.
