The Justice Department moved to dismiss the newly appointed US attorney for the northern district of New York on Wednesday, coinciding with federal judges revealing his appointment to succeed a prosecutor affiliated with President Donald Trump’s administration.
Trump has faced backlash from civil rights and political analysts for what they describe as his administration’s attempts to target political rivals, which have led to legal disputes and public demonstrations.
During a ceremony on Wednesday, the Northern District of New York Board of Judges designated Donald Kinsella to take over from John Sarcone, who had been serving in an acting capacity but was disqualified by a court ruling.
“You are fired, Donald Kinsella,” Deputy Attorney General Todd Blanche posted on X. “Judges don’t select US Attorneys, @POTUS does.”
Kinsella, who was not immediately available for comment, brings decades of experience in both criminal and civil litigation. He previously served as an assistant US attorney and held the position of criminal chief at the Justice Department.
Last month, a federal judge determined that Sarcone was unlawfully serving as the state’s top federal prosecutor in Albany and prohibited him from participating in an investigation involving state Attorney General Letitia James.
On Wednesday, the department’s website listed him as the “first assistant US attorney.”
The DOJ employed various procedural tactics to keep Sarcone as acting US attorney for the northern district after a federal court refused to extend his 120-day interim term.
These actions were ruled unlawful in court, similar to other rulings that rejected appointments in California, Nevada, and New Jersey.
The Trump administration has particularly focused on James, an elected Democrat considered one of Trump’s key political adversaries. She has claimed that investigations against her are retaliatory measures for suing Trump’s family business.
