Understanding the Talking Filibuster and the SAVE America Act

Some Republicans, like Utah Sen. Mike Lee, are looking to implement a talking filibuster. This lengthy tactic would force opposing Democrats to speak continuously for hours, effectively halting Senate proceedings.

Although Democrats hold a minority position in the Senate, they can block the SAVE America Act. Despite pressure from President Donald Trump for Republicans to pass this bill, they seem unlikely to utilize the talking filibuster-though some party members are advocating for it.

Senate Majority Leader John Thune from South Dakota has stated that he won’t pursue this route. Instead, Republicans plan to stall debate over the next week or so, compelling Democrats to publicly justify their opposition before voting on the bill. This approach won’t be a talking filibuster and is anticipated to lead to an unsuccessful vote. The Senate is expected to start this process on Tuesday.

What’s the difference between a talking filibuster and a regular filibuster?

You won’t actually find “filibuster” mentioned in the Senate rules. It refers to an established practice where debate is prolonged in order to obstruct legislation’s passage or extend discussions before voting.

Most bills need just a simple majority-51 votes-to pass through the Senate. However, three-fifths of senators-60 members-must agree first if they want to end debate and proceed with voting on any given bill. That’s where the concept of a filibuster comes into play.

If a majority leader believes their party lacks support from 60 members, they’re typically discouraged from presenting that bill since it wouldn’t clear debate hurdles. An alternative exists: allowing debates linger until opposition wanes.

A talking filibuster usually kicks off when the majority leader brings forth a bill for discussion. If approved by a simple majority, then debate opens up on that floor. According to Senate rules, each senator gets at least two chances at speaking and can talk as long as they can stay standing without eating or taking bathroom breaks.

During this time frame, senators who oppose that particular legislation can propose numerous amendments-all of which come with their own periods for discussion.

This becomes an endurance test that could stretch out over weeks or even months. However, if those backing the legislation can tire out their opponents rather than seeking early closure via 60 votes for ending debates prematurely; they could advance and pass it with just simple majority support-a feat that’s been rare in recent history.

Why is this such a challenge for Republicans?

President Donald Trump has been one of SAVE America Act’s most vocal advocates. He’s threatened not to sign many bills until this one gets through while adding fresh demands like banning most mail-in ballots. The act aims at reducing noncitizen voting-a concern substantiated by data but considered too infrequent overall not influencing election results significantly.

Democrats argue that this legislation could disenfranchise countless voters who can’t provide necessary citizenship documentation.
